AN ORDINANCE ADOPTING A WIRELESS COMMUNICATION MASTER PLAN AS AN AMENDMENT TO THE CITY OF MAIZE, KANSAS, COMPREHENSIVE PLAN.

RECITALS

The City of Maize, Kansas (“City”) Zoning Code references a Wireless Communication Master Plan; and

To date a Wireless Communication Master Plan has not been approved by the City Council; and

By this ordinance the City Council is approving a Wireless Communication Master Plan that is to serve as the Wireless Communication Master Plan that is referenced in the City Zoning Code; and

Under authority granted by statute (K.S.A. 12-747 et seq.) the City Planning Commission adopted a Comprehensive Plan that was subsequently approved by the City Council in April 2019; and

The Comprehensive Plan may be amended from time to time to ensure it reflects timely and relevant information and the needs of the City; and

On October 2, 2025, the City Planning Commission initiated a Wireless Communication Master Plan to address mandates by the State of Kansas contained in K.S.A. 66-2019 and mandates of the United States Federal Communications Commission contained in Declaratory Ruling FCC-18-133; and

The City Planning Commission gave notice in the official city newspaper on September 11, 2025 of a public hearing to consider the adoption of the Wireless Communication Master Plan as an amendment of the Comprehensive Plan; and

The Wireless Communication Master Plan that was considered by the City Planning Commission is titled “Wireless Communication Master Plan” that was adopted by the City of Wichita, Kansas, on March 19, 2019, and by the Board of County Commissioners of Sedgwick County, Kansas, on March 20, 2019; and

A copy of the Wireless Communication Master Plan is attached to this Ordinance as EXHIBIT A; and

The City Planning Commission gave notice by publication in the official city newspaper on September 11, 2025, of a public hearing to consider the adoption of the Wireless Communication Master Plan that is attached as EXHIBIT A to this ordinance; and

The City Planning Commission held a public hearing on October 2, 2025, at which a quorum was present and heard all comments and testimony relating to the Wireless Communication Master Plan; and

On   October 2, 2025, the City Planning Commission, by affirmative vote adopted the Wireless Communication Master Plan and recommended that the governing body of the City adopt the Wireless Communication Master Plan.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MAIZE, KANSAS:

Section 1. The City approves the adoption of the Wireless Communication Master Plan that is attached to this ordinance as EXHIBIT A as an amendment to the City Comprehensive Plan.

Section 2. The Wireless Communication Master Plan shall apply to all of the land located within the corporate limits of the City. References to duties of the “City of Wichita” and “Sedgwick County” contained in the Wireless Communication Master Plan shall be deemed to include the City of Maize and its officers, officials and staff where appropriate.
